Job Description

Role Overview

This position places you at the centre of a busy civil litigation desk, steering commercial debt recovery files, insurance defence instructions, running down claims and personal injury disputes from the moment a client gives instructions until the matter is finally determined or the money is recovered. Your week will move between drafting pleadings and formal opinions, appearing before magistrates and judges, negotiating with opposing advocates, loss adjusters and claims officers, and pursuing enforcement against debtors who will not pay voluntarily. The firm depends on this role to keep a high-volume portfolio moving without a single missed limitation date or statutory deadline, so it suits an advocate who can carry files independently and report clearly to clients and supervising partners.

Key Responsibilities

  • Prepare and file pleadings, witness statements, lists of documents, third-party notices and formal legal opinions, with particular attention to motor accident and running down claims.
  • Assess liability exposure and quantum, then advise insurance clients on whether a file is better resolved through settlement or defended at trial.
  • Appear in the Magistrates' Courts and the High Court for mentions, interlocutory applications, formal proofs, full trials, cross-examination and written submissions, and represent clients at court-annexed mediations.
  • Negotiate out-of-court settlements with opposing counsel, loss adjusters and insurance claims officers, and document the agreed terms in consent orders.
  • Run the recovery cycle end to end: issuing statutory demand letters, agreeing structured payment plans, filing recovery suits and summary judgment applications.
  • Enforce judgments through warrants of attachment, garnishee proceedings, judgment debtor summonses and court auctioneers.
  • Manage case files through the Judiciary E-Filing portal and diarise cause lists, statutory timelines and limitation periods so that nothing lapses.
  • Provide corporate clients, insurance panels and supervising partners with timely, accurate progress updates and status reports, and handle other practice-related duties as assigned.

Requirements & Qualifications

  • Bachelor of Laws degree from a recognised university.
  • Admitted as an Advocate of the High Court of Kenya and holding a current Practising Certificate.
  • At least two years' experience in a litigation firm, with a caseload centred on insurance claims and debt recovery.
  • Solid grounding in civil procedure, tort and negligence, insurance law, contract law and the judgment execution process.
  • Hands-on familiarity with the Judiciary E-Filing system, virtual court platforms such as Microsoft Teams and Zoom, and standard law practice software.
  • Demonstrated ability to carry a large caseload under tight deadlines without losing accuracy.
  • Strong legal drafting, research and courtroom advocacy skills, backed by negotiation ability that closes debt and liability claims efficiently.
  • Professional, honest and dependable, with the confidence to work independently and with minimal direction.
