A petitioner has moved to court seeking the revocation of the Creatives Technical Committee a committee under the Talanta Hela Council formed by Youth Affairs, Sports and Arts Cabinet Secretary Ababu Namwamba.
In the petition filed by Mugane Advocates on Tuesday, Charles Mugane argues that the committee, chaired by comedian Daniel (Churchill) Ndambuki is illegal and persons appointed in the committees were chosen with no regard to "the principle of meritocracy".
He further claimed that the appointments are the reward of political cronies adding at the expense of the thin public coffers "which matter is a betrayal of the public trust bestowed upon you by the Kenyan citizenry."
The petitioner further states that the appointments were made in breach of Article 10 of the Constitution which sets out the national values and principles of governance, including public participation, good governance, transparency and accountability.
He says that the selection process used was shallow and is a clear indication of abuse of office.
"Certainly, no selection process has been shown of how the eleven were arrived at from the massive eight million Kenyans on the TikTok platform where the appointees appear to have been drawn from," read part of the petition.
"Your actions above are a blatant disregard of the law which our client shall not countenance."
Mugane, therefore, demanded that he be furnished with evidence of public participation on the establishment of the council and the committee.
He also wants the budget for the council and the committee be provided and a statement of expenditure showing what has been incurred and expended.
Other demands he made were to receive the source of the funding for the body and the selection criteria used for the appointments.
While that is being treated, he wants the commitee to be revoked within the next 48 hours failure to which he will file a suit against the Sports CS.
CS Namwamba formed the commitee on February 11 and the members appointed are to serve for a period of three years.
Digital strategist Dennis Itumbi, Kizito Wangalwa, David Langat, Debra Mallowah, Abraham Kipyego Mutai, Charles Gacheru, Claudia Naisabwa Leshomoo, Nobert Ouma, and June Chepkemei were appointed to the Talanta Hela Council board, chaired by the CS himself.
On the other hand, the Creative Technical Committee constitutes Akinyi Odongo, Jimmi Gathu, Catherine Kamau, Esther ‘Akothee’ Akoth, Kizito Makhande, TikToker Azziad Nasenya, Rosemary Wahu Kagwi, Awadhi Salim Awadhi, Douglas Kipkirui, Langat Susan Ekasiba, chaired by comedian Daniel ‘Churchill’ Ndambuki.
Another Committee under the Talanta Hela Council is the Sports Technical Committee consisting of Carol Radul, Boniface Ambani, Julius Kiplagat Yego, Neddy Kutsuru, Alfred Makotsi, Sammy Tiyoi Shollei, Collins Kale, Kevin Mutai, Shilovelo Winna Shilavula, Daniel Nakeor Losiru, and Staicy Shariffa Ochieng.
