The ownership battle for a house in Nairobi's Runda area between Aldai Member of Parliament Marianne Kitany and Agriculture Cabinet Secretary Mithika Linturi has taken another turn.
This comes after the court halted the eviction of MP Kitany, who is CS Linturi’s estranged ex-wife, from the house.
The execution of a court order to evict her was thwarted after her lawyers on Wednesday obtained orders stopping her removal, but not before a group of people attempted to forcefully remove her belongings.
The palatial house was the theatre of drama as a team allegedly carrying out the instructions of a court order arrived to take possession of the property on Wednesday night.
The group of men are said to have gained access into the compound and proceeded to evict the occupants of the house.
Kitany has been the most recent occupant of the multi-million house, but CS Linturi got orders to evict her after the courts declared that there existed no marriage between the two, hence she had no claim on the property on that basis.
The eviction on Wednesday night was on the strength of a court order issued on February 7, 2023 that instructed the Runda Police Station to provide security and assistance in evicting Kitany from the house.
However, Kitany's lawyer Moses Kurgat - who was also present during the attempted eviction – said those who came to effect the eviction did so in contravention of the court's orders.
Besides that, lawyer Kurgat also claimed that the eviction was carried out despite the existence of another court order issued on Wednesday by the same magistrate who issued the first one, staying the orders she had issued on February 7 pending directions from the court on February 22.
The police have since taken over the security of the house and kicked out both parties as they await confirmation of the authenticity of the latest court order.
In the meantime, both the MP and the CS will have to wait to find out who between them will have the last laugh.
