Job Description

OVERALL RESPONSIBILITY

  • The role holder is responsible for providing thenecessary legal guidance, support and opinion in all cases pertaining to insurance operations. The role holder will participate in the legal due diligence process and provide inputs on the legal aspects for resolving anycomplex issues related to Underwriting process to safeguard the interests of company. The role holder will also be involved in undertaking legal research, drafting and reviewing various legal documents involved in insurance operations to ensure use of correct legal terminologies and clarity in interpretation of documents. He / She shall represent the company in legal proceedings.

DESCRIPTION OF DUTIES:

  1. Providing proactive and pragmatic advice to the business on all legal and regulatory matters.
  2. Provide legal representation to the Company, take part in formulation and management of corporate strategies and initiatives for all legal aspects of the Company.
  3. Manage legal risk within the business by taking responsibility for providing legal advice to the business on all legal matters.
  4. Managing court cases and disputes affecting the Company and itsclients.
  5. Supervising Legal Department junior staff
  6. Assisting Management in overseeing all legal matters, including managing external legal counsel and providing regulatory liaison.
  7. Receiving Court Summonses and determining whether liability attaches on the partof the Company.
  8. Appointing, supervising, and managing of advocates in the Company’s panel to file defenses or sue on its behalf.
  9. Appointment of service providers for legal related claims.
  10. Formulating Service Level Agreements with lawyers in the panel and ensuring provision of efficient services.
  11. Participate in drawing and vetting of contracts, leases, and other legal instruments. 
  12. Attending Court as a witness and in the company of the Company’s external advocates to provide insights into court cases.
  13. Managing court cases and determining whether suits should proceed to full trial or be negotiated out of court.
  14. Negotiating cases directly with third party advocates, where liability is confirmed.
  15. Perusing through and acting on correspondence and opinions from our advocates within the stipulated turnaround times.
  16. Recommending settlements for judgments, advocates’ and other service providers’ fees.
  17. Assist in processing of payments to claimants and service providers.
  18. Confirming accuracy of fee notes raised by our Advocates in accordance with the Advocates Remuneration Order and ensuring prompt payment.
  19. Perusing through and acting on any correspondence and/or enquiries regarding legal claims within deadlines.
  20. Conducting legal research and preparing legal opinions on liability and quantum/ review such opinions once they are received from external advocates.
  21. Organizing for witnesses to attend court and the Company’s advocates’ offices for pre-trial briefing.
  22. Review investigation reports, to ensure that they are comprehensive enough to meet the need for which they were sought and recommend remedial action as necessary.
  23. Timely review of and determining whether the outcome of court cases should be appealed or not.
  24. Assisting in recovery of the Company’s outlay from third parties.
  25. Advising on the adequacy of claims reserves, reviewing the files and placing the correct reserves for alllegal claims.
  26. Ensuring the Company operates within the laid down regulations and guidelinesas far as claims are concerned.
  27. Any other duties that may be assigned from time to time

Requirements

  1. At least (1) one year experience in similar position 
  2. Practical knowledge inCivil Court Procedures
  3. Excellent Communication, Interpersonal and Presentation Skills
  4. Ability to work well under pressure with others as a team player and meet work deadlines with minimum or no supervision
