Four former Lang'ata Boys High School students who were charged with conspiring to burn the school in 2016 have been put on defense.
However, the court has acquitted 8 others saying there was no case against them
In the case, 12 boys had been charged with three counts of arson and destroying property worth 5.4 million.
In a short ruling delivered on Tuesaday, Senior Principal Magistrate Benard Ochoi said after carefully reading the facts and evidence of the 18 prosecution witnesses, he was satisfied that the four have a case to answer.
“It's the finding of this court that a prima facie case has been established against the four accused persons, however, the court finds that no case has been established against the 8 other accused persons.
“The court has carefully read the facts of this case and the evidence of the witnesses and the issue for determination is whether based on the evidence they have a case to answer,” the court ruled.
In 2021, the Principal and the Deputy Principal of the school testified narrating how the boys allegedly planned the burning of the school.
The court was told how two classrooms were burnt down leading to the arrest of the 12 students who were suspected to have masterminded the arson.
It was estimated that 368 bedsheets, blankets, 184 student boxes and personal belonging valued at over Sh 5million were burnt to ashes
