The Director of Public Prosecutions (DPP) Noordin Haji has received a copy of the investigation file on allegations that police raided the home of former Interior Cabinet Secretary Dr Fred Matiang'i in Karen, Nairobi last month.
In a statement on Wednesday, Haji said that he is set to begin his investigation before a decision is made on whether to charge the former CS.
“Today the 8th of March, 2023, received the duplicate file relating to the allegations that police officers visited and cordoned off the residence of Former Cabinet Secretary, Ministry of Interior and Co-ordination of National Government, Dr Fred Matiang'i with the intention of arresting him on the night of 8th February, 2o23 for undisclosed offence(s),” read the statement.
A cautionary statement from the Directorate of Criminal Investigations (DCI) on Tuesday indicated that Matiang'i could be charged with conspiracy to commit a felony and publication of false information if found to have issued a false statement about the alleged raid.
While reassuring the public of upholding the law as he probes the matter, Haji says that due process will be followed to shed light on the matter.
"The duplicate file herein will be reviewed, and a decision thereto shall be made in due course, based on the evidence, facts, the law, and the Decision to Charge Guidelines, 2019," he said.
"The Office reiterates its commitment to upholding the rule of law and respect to the fair trial to all persons."
The DCI on Tuesday grilled Matiang’i for hours over what they say was falsifying information that police officers raided his Karen home on February 9.
"Between 8th February and 9th February 2023 at Karen View Estate within Nairobi, with intent to cause panic, chaos or violence among citizens of the Republic of Kenya jointly with another published in the media that your house had been raided by a battalion or Garisson of Police Officers intending to arrest you a fact you knew to be false," read a cautionary statement.
His legal team however insists that they have anticipatory bail orders and will not allow their client to be detained unnecessarily.
Matiang'i was released after grilling on the condition that he avails himself without fail should the DCI summon him at any given time.
