Businessman Amos Njugi Wachira has moved to court seeking over Ksh.19 million from Nairobi County, Chief Land registrar and three others for allegedly demolishing his building located at Pangani area, Nairobi.
Wachira says that the property had three blocks comprising of 11 residential units, 4 shops and 2 ablution blocks and fetching a total monthly rental income of Ksh.192,000. He says that he is the bonafide and legitimate proprietor of the said property.
“The conduct of defendants of having the tenants evicted and having the building demolished without due process was illegal and has caused him mental anguish and agony,” he claims.
Despite demand and notice of intention to sue having been given, he says the defendants have refused failed and neglected to settle it.
He also wants the court to cancel the certificate of lease issued to the 1st defendants by the Chief Land registrar.
He is faulting Nairobi City County for allegedly colluding with the Register of Lands to cause the issuance of the purported certificate of lease to Kachuodho Limited while knowing too well that he is the bonafide and legitimate owner of the suit.
When the matter came up for hearing today the court was informed that Kachuodho Limited has not entered appearance in the matter and that the other respondents will not call any witness in the matter.
“This is a land matter –Land cases are very sensitive when you don’t call any witness you throw the court into confusion, “court noted.
Lawyers representing the Nairobi County and Lands Registrar said that they have written many letter to relevant departments in vain.
“Following the said illegal and unlawful demolition of my property on 28th October 2021 and the frustrations I have encounters from the defendants by failing to address my complaint and claim , I have suffered great mental anguish for which I hold all the defendants liable jointly and severally, “court papers read.
